Will Of Ezekiel Edmonds (Proved 20th Sept 1852 )
 

This is the last will and testament of me Ezekiel Edmonds of Berryfield House of the parish of Bradford in the County of Wilts Esquire which revoking all other wills by me at any time heretofore made I make as follows 

I will and direct that all my just debts and funeral and tetstamentary expenses be fully paid and satisfied by my executors hereinafter named and appointed out of my personal estate and effects 

I give and bequeath to my wife Mary Edmonds all my household goods and furniture plate linen china boats prints and pictures wine and other liquors horses carriages and live and dead stock of which I shall be possessed at the time of my decease and also the legacy or sum of two hundred pounds to and for her own use and benefit absolutely 

Also I give and bequeath unto the Reverand John Little of Swidow in the County of Bedford Cleric John Hator of Trowbridge in the County of Wilts Banker and my said wife Mary Edmonds the sum of twenty thousand pounds of lawful English currency upon trust to lay out and invest the same upon Government or real securities in Great Britain in their names and to pay and apply the interest dividends and annual produce thereof to and for the use of or to permit and suffer the same coniced by my said wife Mary Edmonds for her own use and benefir during the term of her natural life in case she shall continue my widow and unmarried until the youngest child I shall leave at the time of my decease or born in the time after my decease or the youngest of such children respectively as shall survive shall attain the age of twenty one years  

And from and immediately after the decease of my said wife Mary Edmonds or her marriage again before the youngest of my children living at the time of my decease or born some time after my decease or the youngest child who shall survive and attain the age of twenty one years I will and direct that my said trustees shall pay and transfer the sum of ten thousand pounds part of the said principal sum of twenty thousand pounds unto my son Frederick Ezekiel Edmonds his executors administrators and assigns to and for his and their own use and benefit absolutely  

And do and shall continue at interest on Government or real securities aforesaid the sum of five thousand pounds of lawful English currency and pay and apply the interest dividends and annual produce thereof to and for the benefit or permit the same to be received by my daughter Mary Anne Edmonds to and for her own use and benefit absolutely independent of and without being subject to the debts control arrangements or interference with any husband with whom she may at any time happen to marry and so that my said daughter Mary Anne Edmonds shall not in any way incvrimivor or charge the same or anticipate the payment thereof 

And the receipt and receipts of my said daughter Mary Anne Edmonds alone whether sole or covort shall be a good and effectual discharge and good and effectual discharges to my said trustees for the payment thereof or for so much money as in such receipt or receipts shall be acknowledged to be received 

And from and after the decease of my said daughter Mary Anne Edmonds upon trust to pay and apply the said sum of five thousand pounds or the stocks funds or securities in or upon which the same may be invested and placed unto and equally between all and every the child and children of my said daughter Mary Anne

Edmonds if more than one in equal shares and proportions        and if but one then to such only child on his her or their attaining their respective age or ages of twenty one years and the interest dividends and annual produce thereof in the meantime or until such child or children shall attain the age or respective ages of twenty one years to be paid and applied to and for the maintainance and education and bringing up of such child or children until he she or they shall respectively attain such age 

And in case all and every such children and child shall depart this life under the age of twenty one years leaving any husband of my said daughter him her or them surviving then in trust to pay and transfer the said sum of five thousand pounds or the stocks funds or securities in or upon which the same shall or may be invested or placed unto and for the benefit of such husband of my said daughter Mary Anne Edmonds so surviving to and for his own use and benefit absolutely  

And I do further will and direct that my said trustees and the survivor and surviviors of them do and shall continue at interest on Government or real securities the sum of five thousand pounds of lawful English money ……
 

(and he repeats it all exactly above for his first daughter, for his second daughter Anna Maria Edmonds) ……
 

…….. for the benefit of such husband of my said daughter Mary Anne Edmonds so surviving to and for his own use and benefit absolutely 

Also I give and bequeath unto my said trustees John Little John Hator and Mary Edmonds their executors administrators and assigns the further sum of three thousand pounds in trust to invest the same upon Government or real security in Great Britain in their or his names or name      And to pay and apply the interest dividends and annual produce thereof to and for the benefit and advantage of my said daughter Mary Anne Edmonds until she shall

attain the age of twenty five years and on her attaining such age if then unmarried to pay assign and transfer the said principal sum of three thousand pounds and the stocks funds and securitiesin or upon which the same shall be invested and placed unto my said daughter Mary Anne Edmonds for her own use and benefit 

And in case my said daughter Mary Anne Edmonds shall happen to marry with the consent in writing of my said wife Mary Edmonds before she shall attain the age of twenty five years     in trust to pay transfer and assign the said sum of three thousand pounds and the stocks funds and securities in or upon which the same shall be invested and palced unto my said daughter Mary Anne Edmonds for her own use and benefit at any time after she shall have attained her age of twenty one years 

….. (and then he says the same thing in full for his other daughter) ….. 

Also I give devise and bequeath unto my son Frederick Ezekiel Edmonds all and singular my freehold leasehold and copyhold Estate and all the Rest Residue and Remainder of my personal estate and effects whatsoever and wheresoever to holod the same unto my said son Frederick Ezekiel Edmonds his heirs executors administrators and assigns for his and their own use and benefit according to the several daneires and qualities thereof respectively 

And I do hereby further will that in case either of my said children shall happen to depart this life under the age of twenty one years that the share of the child so dying under the age of twenty one years shall go to and be divided between the survivors of them their heirs executors and administrators 

And in case more than one of my said children shall depart this life under the age of twenty one years then as well as the original and the remaining share shall go to the survivor his or her heirs executors or administrators 

And in case all my said children shall depart this life under the age of tweny one years I give devise and bequeath all my said real and personal estate subject to the estate and interest hereby given and bequeathed to my said wife unto and equally between all and every the children and child of my brother John Edmonds who shall be living at the time of the decease of the survivor of my said children and the issue of any such children or child of my said brother John Edmonds who shall happen to have departed this life leaving issue their heirs executors administrators or assigns in equal shares and proportions     But such issue of any deceased child or children of my said brother John Edmonds shall have and be divided between them if more than one to the share only which such deceased child or children would have taken and become entitled to in case such deceased

child had then been living 

And I do hereby will and direct that the provision hereby made for my said wife is (a word inserted above) ……….(?) to be in augmentation of the provision made for her by the settlement executed by me provisions to my marriage with her 

And I do hereby further will and direct …. (absolves trustees from losses?) … (appoints trustees and gives one hundred pounds each for their "trouble") … (certain disrcetion on investment) …

… witness whereof I the said Ezekiel Edmonds the testator have at the foot of this my will and of oath of the preceeding sheets thereof set my hand this twenty second day of September one thousand eight hundred and forty nine     Ezekiel Edmonds    signed published and declared by the said Ezekiel Edmonds the testator as and for his last will and testament in the presence of us who in his presence and in the presence of each other have at his request subscribed our names as witnesses the obliteration and interlination in the fifth and sixth sheets being first made

  (adds a fourth exec "my friend John Overbury of Fredericks Place Old Towry in the city of London Merchant" …. on tenth day of August 1852 … witns George Hackman Servant of Mr Edmonds    and    John Bush Solicitor)
