Hart, William Clothier Bradford on Avon
In the name of God Amen. I William Hart of Bradford in the
County of Wilts Clothier being in Health and sound disposing mind and
understanding do make this my last Will & Testament touching the
dispositionof my Temporal Estate
wherewith it has pleased God to bless me…
And as to all and Every my
Freehold Estate Mesuages Lands Tenements Heritaments and Real Estate virtuate
lying and being in the Town of Bradford Aforesaid or Elsewhere – I give and
Devise the same to and Every part and parcel thereof with the Appurtenances…
Unto John Hart now or
late of Langport in the County of Somerset also to William Marvin Everett
Clothier of Heytesbury in the County of Wilts & to Chas Lovegrove of
the Town of Reading in Berkshire Gentm their Heirs and Assignees for Ever But
nevertheless upon Trust and to (be?) used for the ends Intents and Purposes
herein after Mentioned and declared concerning the same that is to say upon
Trust that they the said Jno Hart Wm M Everett and Chas Lovegrove or the
Survivor of them or their Heirs or Assignee of such Survivor shall and do as
soon as Conveniently may be after my decease Either by publick (sic) salesor
private Contract as they shall see most proper Absolutely All and dispose of
the Fee Simple and Inheritance of my said Estate before Mentioned for the best
prize (sic) or prices and for the most money they can reasonably get for the
same…
And Upon Trust & pay to
and Equally divided unto & amongst my Children Except my son William
Hart to Whom I give and bequeath Five Shillings to be paid him by my
Trustees out of my Personal Estate in one month after my Decease but unto the
others my will is they may have Share and Share Alike…
Jn Hart as above named as one of my
Trust Thomas Hart Samuel Hart George Hart Elizabeth Lovegrove Wife of
the said Chas Lovegrove and Charlotte Everett wife of the said Wm
Marvin Everett Equally between them Share & Share Alike at the Time
herein after directed
And I do hereby declare
that the receipts or receipt of my Trustees or the survivor of them his Heirs
or Assignees shall be good and sufficient discharge to any Purchaser or
purchasees of the said premises for his or their money and that such purchaser
or purchasees shall not be obliged to see the Application therof in any respect
or be Accountable for the misapplication thereof or any part of it.
Provided always and I do
hereby Expressly declare it to be my will that they my Trustees and the
Survivor or Survivors of them his (sic) Heirs or Assignees shall and will
permit and suffer my son (sic) Samuel Hart George Hart and the said Chas
Lovegrove or any two of them as Copartners to purchase that part of my
Estate lately Bulgins but since John Jones Esqr…
consisting of Dye house
Washing Ships Yard Stable Horse Wheel path with a building Erected on pillars
called a Larding & Stubing Shop likewise the House wherein are the
Scribbling Ingines also some Larding & Stubing Machines facing Church
Street whose all are situated before expressed and my Will is that they may
purchase it at what is cost myself Viz One thousand Sixty Eight pounds
or there about…
My Will is further declared
if the aforesaid J Hart G Hart & Chas Lovegrove or any Two of
them refuse to purchase in 3 months after Offers made them my Will is it be
offered by my Trustees to Jn Hart aforesaid on his refusal to Tho Hart
aforesaid…
But on his refusal also then
my Will is that my Trustees do sell the said Premises Either by publick sale or
private contract for the best price and for the most money they can reasonably
get for it and upon Trust to pay and
& Equally Divide the same unto and among my Six children viz John Hart
aforesaid Tho Hart Saml Hart George Hart aforesaid Eliz Lovegrove
wife of Chas Lovegrove aforesaid & Charlotte Everett Wife of Wm
M Everett aforesaid Share & Share alike.
My Will is further declared
that the aforesaid Saml Hart Geo Hart
and Chas Lovegrove or any Two of them may by my Trustees have the
first offer to purchase all my Right and Tithe and Interest of that part of my
Estate lying and being partly in Pippit street & partly the
northside of Church Street in Bradford aforesaid consisting of new Shear
Shop picking Shop Stove press Shop Trying Shop Dubing Shop & Sping Shops
over the same Two Batches for Drying Wool Compting House & all the long
range of rooms Adjoining lying & being Situate in Pippit Street also
two Tenements in the occupation of Rob Mundy & Abrm Stokes
being situated on the Northside of Church Street in the Parish of Bradford
aforesaid likewise my Will is further declared that the Two Fields by and near
to Belcombe Brooke in the Parish of Bradford aforesaid may by my
Trustees be offered in like manner to be purchased by S Hart Geo Hart as
Copartners in Trade for the the first cost price together that is to say the
Above Shops in Pippit Street & two Tenements northside of Church
Street before mentioned in the Occupation of Robt Mundy & Abrm
Stokes cost me One Thousand One Hundred and Twenty Seven Pounds & 10
shillings including the said Fields but should they refuse to purchase the
Fields and premises my Will is that my Trustees do sell the Premises &
Fields either by Publick Sale or private contract for the best price & most
money they can get and the money received by them upon Trust (by themselves) or
their Heirs or Asignees the survivor or survivors of them and I do hereby
declare that the receipt or receipts of my Trustees or the survivor of them his
Heirs or assigns shall be good & sufficient discharge to any Purchaser or
Purchasers of the said Premises and Fields and the money recd by them upon
Trust to be Equally divided unto and among my Children herein after named the
said John Hart Tho Hart Saml Hart George Hart Eliz Lovegrove & Charlotte Everett Share & Share alike
And justso do further
declare it to be my Will that my said Trustee or the survivor of them his Heirs
or Assignees shall make an Offer of the Messuage Tenement & Garden with the
Apurtences thereunto belonging situate and being in Church Street in the parish of Bradford aforesaid and now
in the occupation of Edw Pearce at 10£ per annum for Two Hundred
pounds to S Hart & G Hart but if they refuse, then as before to J
Hart if he refuse to Purchase it
then to Tho Hart if all refuse then my Will is after three months notice
to them by my Trustees that they sell it either by private contract or by
Publick sale for the best price and most money they can get for it and the
money upon Trust to be Equally divided share and share alike to my Children Jn
Hart Tho Hart Saml Hart Geo Hart Elizabeth Lovegrove and Charlotte Everett…
And
as to all and every my Household goods, Furniture plate Linen China goods
Chattles Stock and utensils in Trade money necessity for Money and all other my
personal Estate and Effects whatsoever and wheresoever and of what nature and
kind soever the same may be which I shall be possesst (sic) of or Entitled unto
at the time of my decease I give & bequeath the same and every part and
piece(?) therof unto the said Jno Hart W M Everett & Chas Lovegrove In Trust that they or the Survivors of them
or the Executors or administrators of such survivor do and shall as soon as
conveniently may be after my decease sell and dispose of such part or parts
thereof as shall not consist in money and collect and get in and receive all
other my said residuary Estate and the money so to be got in and receive and to
arise from my said residuary Estate do and shall pay and Divide unto and
amongst my said Children Jno Hart Thos Hart Saml Hart Geo Hart Eliz Lovegrove
Wife of the above said Chas Lovegrove & Charlotte Everett Wife of said W M
Everett Equally between them Share & Share alike…
Provided always and I do
hereby declare and direct that my Trustees the survivor of them his Heirs or
Assignes do pay within Eight Callinder (sic) months after my decease Two
Hundred pounds to my Son Thomas Hart out of my Personal Estate and
Effects over and above his share in Common with Jn Hart Saml Hart Geo Hart Eliz
Lovegrove & Charlotte Everett before given & bequeathed in this my Will
& Testamony (Tho Hart having received that sum less than his Bros)…
I also declare it to be my
Will that my just debts and Funeral Expenses and the expense of proving this my
will and all other incidental expenses relative thereto and also the Legacy by
me hereafter bequeathed to be paid taken out of my said residuary Estate before
any division thereof I give my Bro P Hart Five Guineas and to my
sister Ann Hancock Five Guineas I also give Mary Thomas my sister in law if she remain the Widow Thomas at
my decease to buy her mourning as a token of respect Five Guineas to be
paid Her by my Trustees in three months or sooner after my decease and should Mr
J Barnett the present Baptist Minister be the Minister of the Baptist
Church & Congregation at the time of my Decease my Will is that my Trustees
give him Two Guineas instead of a Ring the week after my Internment…
I hereby constitute them the
said Jno Hart Wm Marvin Everett and Chas Lovegrove Executors in Trust to this
my last Will and Testament and I direct that my said Trustees or Trustees &
Executors shall not be accountable or answerable one for the other or for the Acts receipts neglects or defaults
of the other but Each for his own wilfull (sic) neglects and faults only and
that they my said Trustees and Executors may deduct and retain all reasonable
charges and Expenses attending the execution of the Trust hereby Reposed in
them…
Lastly I revoke all former
Wills by me at any time Heretofore made and declared this only to be and
contain my last Will and Testament…

this my last Will and Testament Written by my own Hand and contained in three
folio sides to the first two sides thereof set my Hand and to the Third and
last side thereof set my Hand & Seal this 31st day of Octo
