Those two marked “888/2 on CD” are extracted from a purchased data CD.

Not shown here, there are also on the CD an 1853 Will, and an Indenture (Marriage Settlement), concerning a John Edmonds of Princes Risborough in Buckinghamshire which. Although it’s in the Wiltshire CRO, is hard to connect it to the Bradford-on-Avon Edmonds family.

15/5/1855 – Notice to John Edmonds and Ezekiel Edmonds (Jr) and William Charles Webb, all of BonA, ref to Fredk Ezekiel Edmonds (of Berryfield House) & Emma’s Marriage Settlement, that Ezekiel Edmonds assigned to the Trustees £15,000 to which Ezekiel Edmonds was entitled to as the residual legatee of his late father Ezekiel Edmonds (Snr) of Frankley House nr BonA, being part of monies secured to his Fredk Ezekiel Edmonds’s father at 5% pa by Bond, dated 22/12/1847 by John Edmopnds, Ezekiel Edmonds (Jr) and Samuel Edwin Edmonds since deceased, and also by another Bond dated 8/5/1855 of Ezekiel Edmonds (Jr) and Wm Charles Webb, and also by an insurance policy dsated 19/9/1849 with the Caladonian Life Ins Co, whereby £2,999-19-0 was to be paid to Ezekiel Edmonds (Sr) on the death of John Edmonds, the policy having been assigned by Ezekiel Edmonds (Jr) to Ezekiel Edmonds as security for £3,000 of the said £15,000.  And also the “equitable change” by Ezekiel Edmonds (Jr?) of freehold property and “hereditaments” at Greenland, the property of Ezekiel Edmonds (Jr?), for £2,000 further part of the £15,000.

15/5/1855 – Notice to Trustees of Ezekiel Edmonds (Sr) (late of Frankley) will by Ezekiel Edmonds (of Berryfield House) (copy to his mum of Berryfield House in other doc) re (ref to Fredk Ezekiel Edmonds’s Marriage Settlement) Ezekiel Edmonds assigning £10,000 from his entitlement under his dad’s will of 22/9/1849, being part of £20,000 mentioned in that will, (possibly to?) satisfy terms of his Marriage Settlement.

15/5/1855 – Notice to Execs of Samuel Everard’s will (late of Spalding), by Emma Calthrop, of her share in $3,506.  Ref to Fredk Ezekiel Edmonds’s Marriage Settlement of 9/5/1855, Emma assigns to Ezekiel Edmonds “…1/13th part a share and all that other the part share and interest… in the sum of £3,506 (being one Morihy(?) of a sum of £7,012 the purchase money secured on the Sale of a certain Estate devised by the will of Samuel Everard in trust for sale as mentioned) to which she was entitled under the will of her grandfather the said Samuel Everard dated 13/12/1827)…” subject to her mum’s interest, with full power for Ezekiel Edmonds to discharge the money.

2/12/1856 to 31/3/1876 – Nine “Consolidated £3 Per Cent Annuities” (Bank of Eng) handled by John Slater, Henry Everard, and Edward Everard (Trustees of Emma’s Marriage Settlement).  Various values and timing, add up to just over £10,000

8/5/1855 – Marked “B” (ref Index) and “In Chancery”, with a cover note dated 6/12/1867 re Fredk Ezekiel Edmonds to his mum, and arbitration over Church St Mill

            An Agreement made between Fredk Ezekiel Edmonds esq of Berryfield House and Ezekiel Edmonds jr of BonA Clothier, re an estate free from encumberances, of 3/4 share in property “…in Church Street BonA built by John Saunders deceased and late in occpn of John Edmonds, Ezekiel Edmonds jr, and Samuel Edwin Edmonds, and now of Ezekiel Edmonds jr and William Charles Webb his partner… all those clothing mills or factories adloining and the stock mill, warehouses, workshop, wool lofts, drying stoves, ware rooms, cottages, dye houses, and other buildings in and about the said mills factories and workshops…”, and Ezekiel Edmonds jr has possession (unencumbered) of fourth part, and Fredk Ezekiel Edmonds and Ezekiel Edmonds jr desire to effect a partition, Fredk Ezekiel Edmonds nominates George Haden of Trowbridge (“Engineer”) and Fredk Ezekiel Edmonds nominates Charles Gane of Tbr (“Builder”) as Arbitrators, and Arbts in turn nominate “Withers of Norton St Phillip, Builder” as Umpire.

            The Arbts must define tha apportionment without dividing walls or :actual division” except by boundary marks “during the continuance of a Lease agreed to be granted” by Fredk Ezekiel Edmonds, to Ezekiel Edmonds jr and WC Webb “of the divided portion… allotted to Fredk Ezekiel Edmonds…” (although the Arbts can devise a partition wall as long as it doesn’t diminish the market value of either part or compromise the 3:1 shares, or render either part less useful??) (or agree to a value in compensation??), and each part will belong to Fredk Ezekiel Edmonds and Ezekiel Edmonds jr through a Deed of Covenant and all this has to be done by 1/7/”next” (1855), but no later than 1/8/1855 else it goes to the Umpire for decision by 1/10/1855 at latest and binding on all.

10/5/1855 – Release from Fredk Ezekiel Edmonds to Execs/Trustees of his dad’s will (John Slater of Tbridge, Mary Edmonds of Berryfield House, his widow, & John Overbury of Fredericks Place Old Jewry London, Merchant).  Will dated 22/9/1849 said… household stuff to his wife plus £200 cash, £20,000 invested in Trust for his wife Mary… as long as unm, until youngest turns 21, at which £10k of £20k paid to Fredk Ezekiel Edmonds and other £10k div between his two daus Mary Ann and Anna Maria, and further £3k in Trust is Govt Securities for each dau until 25 or marries, when each gets the principle.  And to Fredk Ezekiel Edmonds all his Real Estate and the balance of his estate.

            And codicil 10/8/1852 appting John Overbury another Exec

            And that Ezekiel Edmonds (Sr) died 21/8/1852, Will proved 20/9/1852, and that all 3 kids survived

And that Ezekiel Edmonds at the time of death was entitled to £32.000 (the bal of £38k secured by Bond dated 2/12/1847 under hands of John Edmonds, Ezekiel Edmonds “the younger”, and Samuel Edwin  Edmonds all of BonA Clothiers, by which the £32k and interest at 5% to be paid to Ezekiel Edmonds (Sr) on 1/1/1855, unless required earlier where then to be paid by 3 equal payts 6 months apart from that date.

And as Samuel Edwin  Edmonds retired from “the partnership business, and is since dead”, and as the Wills execs have recd from John Edmonds nad Ezekiel Edmonds (jr) on 12/10/1853 £12k in pt payt of outstanding £32k, and on 16/12/1854 the execs recd from John Edmonds and Ezekiel Edmonds a further £5k, with £15k still outstanding.

And as mum is still unm and both daus are under 21, and as Fredk Ezekiel Edmonds attained 21 on 17/1/1855, and all things paid by execs as reqd except specific £20, £3k and £3k (for 3 kids), also notes that execs leant money to Wadham Locke, and that execs have appolied some incomes to Fredk Ezekiel Edmonds’s education, and that accounts attached covering Ezekiel Edmonds’s death to this date, and that 2 girls have had £90 pa, Fredk Ezekiel Edmonds directs an extra £50 paid (once?), then Fredk Ezekiel Edmonds now gets rest of estate.

And as Ezekiel Edmonds the younger on behalf of self and John Edmonds made a claim against the estate of Ezekiel Edmonds re debts owing to the (previous) partnership at time Ezekiel Edmonds retired from it, which ahs “proved to be bad”, and as execs decreed it “not proper to entertain such claim” waited until Fredk Ezekiel Edmonds turned 21 to have it settled by him (which he accepts to do as part of his later duties), whatever the outcome, with no impact on the other’s estates.

The Marriage Settlement between Ezekiel Edmonds and Mary Hart  (888/2 on CD)
 

            Indenture made 18/2/1833 between Ezekiel Edmonds of BonA Clothier, Mary Hart of BonA the eldest dau of Samuel Hart of BonA Clothier; and Samuel Slater of Trowbridge and Joseph Overbury of Cheltenham – a marriage (to be) solemnized (soon) between Ezekiel Edmonds and Mary Hart.

And in order to make some provision for Mary Hart in the marriage, Ezekiel Edmonds has agreed to enter into a Covenant for payment (to the Trustees) of £3,000 in Trust (in consideration of 5/- paid to Ezekiel Edmonds before signing by Ezekiel Edmonds ??).   Ezekiel Edmonds then promises to the Trustees that he will in case the marriage shall take effect will pay to the Trustees £3,000 (being) - £1,000 1/3/1833 – £1,000 1/3/1854 – remaining £1,000 on 1/3/1835.

            And agreed that Trustees are paid on Trust to invest in secure Govt Stocks and shall from time to time on consent of Ezekiel Edmonds and Mary Hart be re-invested and shall apply the interest and dividends durin Mary Hart’s life as she thinks fit, and at her death during Ezekiel Edmonds’s life the income goes to their children in Trust if under 21 equally, and principle equally on marriage (followed by a second page, all conditions and possible circumstances and blah blah blah).

An Indenture to change Ezekiel Edmonds & Mary Hart’s Marriage Settlement Trustees (888/2 on CD) 

            This has a cover note that’s dated 1/9/1852 and bears Ezekiel Edmonds’s and Mary’s signatures (but Ezekiel Edmonds died 21/8/18/52 ?), witn J.G. James BonA Clothier and John Bush BonA “Sol” (solicitor?), singed also by John Overbury (witn George? Martin, Bush’s Clerk) and John Slater (witn John Bush).  Note says that Overbury and Slater as Trustees undewr the attached Deed acknowledge William Harcomb, John Goldsmith, & William Fowler as the execs of the Will of Samuel Slater deceased, have this day (1/9/1852?) trsfd £3,022-13-3 (of) 3½ % Bank Annuities, now 3¼ % Bank Annuities, into their names in the Bank of Eng… Trust Fund (as referred to in the Indent attached)…

            Indenture made 6/11/1851 between Ezekiel Edmonds (Sr) of Berryfield House Gentleman and Mary his wife; and John Overbury of Frederick Place, Old Jewry London, Cloth Factor and John Slater of Trowbridge Gentleman –

            Ref to Ezekiel Edmonds and Mary’s Marriage Settlement of 1833, and the Samuel Slater Clothier and the Joseph Overbury in it, and the £3,000 involved, then outlines the role of the Trustees (then Samuel & Joseph) then a lot about how the Trustees operate (if a relpacement is needed?)

            And whereas the said intended marriage soon after the date and execution of the Indenture was duly solemnized and Ezekiel Edmonds paid to Samuel Slater one of the Trustees £3,000 which was invested by him on 16/7/1834 in (the above) Bank of Eng Annuities in the name of Samuel Slater to the a/c of the Execs of his last Will & Tstmnt

            And whereas Joseph Overbury died during the life of Samuel Slater, and Samuel Slater lately died with a Will and appointed William Harcomb, John Goldsmith, and William Fowler as his execs, and was since proved

            And whereas Ezekiel Edmonds and his wife Mary have the to appoint new Trustees, have requested John Overbury and John Slater, and Ezekiel Edmonds and Mary have requested (those 3) as execs of Samuel Slater, to trsf the £3,022-13-3 into the names of their new Trustees
