This is the last Will and Testament of me William Henry Chapman of Pimlico Wharf Lower
Belgrave Place Pimlico in the county of Middlesex Timber Merchant, being of
sound mind and memory and understanding at the time of making the same first
and direct all my just debts funeral and testmentary expenses be paid by my
Executrix and Executor hereinafter named and appointed by and out of my
residuary estate hereinafter given and bequeathed as soon as conveniently may
be after my decease
I give and
bequeath all that my interest part or share of and in the leasehold estates
premises capital store goods chattels effects utensils trade goodwill and
profits of and belonging to and arising from the copartnership trade or
business now carried on by me and Joseph Lambert at Pimlico Wharf aforesaid and
also at No. 2 Wharf Lower Belgrave Place aforesaid as Timber Merchants and also
all other my leasehold estates and premises and capital invested in the said
copartnership business exclusive and inoperment
of the said copartnership business unto the said Joseph Lambert his executors
and administrators upon Trust that if the said Joseph Lambert his executors or
administrators do and shall pay all that unpaid interest part or share of the
rents and profits of the said copartnership leasehold estates and premises and
copartnership business and also the rents and profits of my said leasehold
estates and premises separate from the said copartnership except as hereinafter
mentioned
Unto my dear
wife Isabel Chapman for and during the term of her natural life provided she
remains my widow And in case my said wife shall at any time after my decease
marry again Then upon Trust that if he the said Joseph Lambert his executors or
administrators do and shall pay unto her my said wife out of my said interest
part or share of the said rents of the said joint leasehold estates and
premises and profits of the said joint trade and business and from the rents
and profits of my said separate leasehold estates and premises exclusive of the
said copartnership except as aforesaid one annuity or yearly sum of one hundred
pounds for and during the term of her natural life to and for her separate use
and benefit and free from the debts control or engagements of any future
husband with whom she may intermarry
And I direct that her ectapl
and receipts alone notwithstanding coverture
shall be a good and a sufficient discharge or good and sufficient discharges to
my said trustee flw executors or administrators
for the same annuity or yearly sum of one hundred pounds And in case of any
such marriage by my said wife after my decease then and in such case and from and
immediately thereafter I give and bequeath such interest part or share of and
in the said joint business and of the said copartnership leasehold estates and
premises and also the rents and profits of my said separate leasehold estates
and premises (except as aforesaid) subject to the [inserted] bequest of the said annuity or yearly sum of one hundred
pounds to my said wife
Unto my Nephew
John Chapman now in my employ to and for his own use and benefit And upon
further Trust that my said trustee his executors or administrators do and shall
by and out of my said capital so invested by me in the said copartnership
business pay the sum of seven hundred pounds sterling
To my brother
Richard James Chapman of Haddenham in the County of Bucks Farmer Also the further
sum of two hundred and fifty pounds sterling [inserted] use-
To my Sister
Ann Evans of Adelaide South Australia widow to be paid only and in the event of
the return of my said sister to this country and the further sum of one hundred
pounds sterling
To my Niece
Mary Scott the wife of [space left]
Scott of Saint Saviours near Hastings Sussex
Stone Mason to and for her separate use and benefit and free from the debts
control or engagements of her present or any future husband with whom she may
intermarry And I direct that the receipt alone for the said legacy or sum of
one hundred pounds shall notwithstanding reverture
be a good and sufficient discharge to my said trustee his executors and
administrators
And from and immediately after the decease of
my said wife Then I give and bequeath all that my said interest and share of
and in the said copartnership stock in trade and effects and of the profits
arising from the said copartnership business and the said copartnership
leasehold estates and premises and also all those my separate leasehold estates
and premises (except aforesaid) unto my Nephew the said John Chapman to and for
his own use and benefit
I give and
bequeath All that my leasehold piece or parcel of ground with the messuage
tenement or dwellinghouse thereon erected and built situate and being No. 7
Notting Hill Square Middlesex aforesaid together with the appurtenances unto my
said wife to and for her own separate use and benefit and free from the debts
control or engagements of any future husband with whom she may intermarry and
subject to the rent and warrants reserved and
contained by and in the Indenture of Lease under which I hold the same premises
I give and bequeath unto my said wife all my household furniture goods chattels
linen plate china glass pictures books and other effects in and about the house
in which I reside to and for the separate use and benefit as aforesaid
And as to all
the Rest Residue and Remainder of my estates and effects whatsoever and
wheresoever after payment of my debts funeral and testamentary expenses I give
and bequeath the same and every part and parcel thereof unto my Nephew the said
John Chapman to and for his own use and benefit
And I nominate institute and appoint my said wife and the said Joseph
Lambert Executrix and Executor of this my last Will and Testament And I hereby
declare my will to be that it shall and may be lawful to and for my said
trustee Executorix and Executor their executors and administrators by and out
of all or any of the monies which by virtue of this my Will or any trusts
therein declared shall come to his her or their
hands to deduct retain to and reimburse himself and themselves all such costs
charges and expenses as he she or they shall or may sustain expend or be put to
in or about the execution of this my Will or incident
thereto and that he she or they shall be charged and chargeable only for and
with his her or their own receipts payments and wilful defaults only and not
otherwise and shall not be charged or chargeable with and for any money other
than such as shall actually come to his her or their hands by virtue of this my
Will or for any cost which may be sustained by
the failure of any Banker or Banks with whom the said trust monies or any part
thereof may have been intrusted for save custody
And I do hereby
revoke and make void all former and other Will and Wills or Testamentary
Depositions by me at any time or times heretofore made and declare this only to
be and contain my last Will and Testament

Testament contained in these sheets of paper to the first two sheets thereof
set my hand and to this third and last sheet thereof my hand and seal this
ninth day of July in the year of our Lord one thousand eight hundred and forty

said testator William Henry Chapman as and for his last Will and Testament in
the presence of us who in his presence at his request and in the presence of
each other have here unto subscribed our names as witnesses.

… names his
wife Isabel and business partner Joseph Lambert co-executors
… all of his
partnership interests with Joseph Lambert he gives to his partner to hold in
trust while his wife Isabel is alive.
(In the 1841 Directory of London William is listed as
a “Timber Merchant” of No. 31 Lower Belgrave Place, Pimlico, and at No. 32 is
listed Joseph Lambert, also “Timber Merchant”).
… from which
she is to be paid a hundred pounds a year (regardless if she remarries or not?)
… a lump sum of
seven hundred pounds to his nephew John Chapman (who is currently in his
employ)
… a lump sum of

left over, after personal debts and funeral expenses, goes also to his nephew
John Chapman

is “Proved” in London on 11th Oct 1845, presumably just after his
death
